Hot Topics In Criminal Procedure

For those of you studying for the bar, here’s another list from Professor Whitebread of big topics in crimpro to know for the bar exam:
  1. Exclusion and limitations on exclusion and the fruit of poisonous tree doctrine.
  2. Search and SeizureÃ¢â‚¬â€ťexaminers love this. (Consult flow chart on p. 5 on Conviser mini-review.)
  3. Miranda (at least 3 Miranda-based questions on MBE and essay questions often couple it w/other issues).
  4. Pre-trial IDÃ¢â‚¬â€ťno right to counsel for photo arrays.
  5. Right to jury trial and guilty pleas.
  6. Ineffective assistance of counsel (for state essays).
  7. Know both parts of 5th Amendment: double-jeopardy and the 5th Amend. privilege against compelled testimony.
If you’re taking BarBri you’ll hear the same points; if you’re not, well this might be interesting information for you. Also, if you’re taking BarBri and haven’t covered crimpro and crimlaw yet, it’s something to look forward to. Not only are these the most interesting subjects on the MBE (ok, maybe I’m biased), but Whitebread is by far the most entertaining lecturer thus far. We’re currently doing torts w/Richard Conviser. Let me just say: Not nearly as fun. Ahem. (Of course, I’ve never really made friends w/tort law and all its pretenses to objectivity and damages-parsing, so that definitely doesn’t help.)
